1. Acceptance of Terms

Welcome to Lumiere Interiors! By accessing or using our services, whether on our website (www.lumiereinteriors.com) or through direct engagement with our design team, you agree to be bound by these Terms and Conditions ("Terms"). These Terms govern your access to and use of our services, including all content, functionality, and services offered. If you disagree with any part of the Terms, then you may not access the services.

2. Service Description

Lumiere Interiors, located at 1200 Brickell Avenue, Suite 800, Miami, FL 33131, provides comprehensive interior design services, encompassing:

  • Residential Interior Design: Creating personalized and functional living spaces tailored to your lifestyle.
  • Commercial Interior Design: Designing productive and aesthetically pleasing workspaces that enhance brand identity and employee well-being.
  • Space Planning: Optimizing layouts to maximize usability and flow within a given area.
  • Furniture Selection and Styling: Curating and sourcing furniture, décor, and accessories that complement the overall design aesthetic.
  • Renovation and Remodeling: Managing and executing interior renovation projects, from initial design to final installation.
  • Consultation Services: Providing expert advice and guidance on various aspects of interior design.

Our team, led by Principal Designer Isabella Rodriguez, works closely with clients throughout the design process to ensure their vision is realized. We utilize industry-standard software and best practices to deliver high-quality design solutions. Project timelines and specific deliverables will be outlined in individual project agreements.

3. User Conduct

As a user of our services, you agree to conduct yourself responsibly and ethically. This includes:

  • Providing accurate and complete information during consultations and throughout the design process.
  • Respecting the intellectual property rights of Lumiere Interiors and third-party vendors.
  • Communicating professionally and respectfully with our design team and other personnel.
  • Adhering to all applicable laws and regulations while using our services.
  • Not engaging in any activity that could disrupt or damage our website or services.
  • Not misrepresenting your affiliation with Lumiere Interiors or using our branding without express written consent.

Lumiere Interiors reserves the right to terminate your access to our services if we determine that you have violated these standards of conduct. Any abusive, harassing, or threatening behavior towards our staff will result in immediate termination of services.

4. Payment Terms

Payment for Lumiere Interiors' services is structured as follows:

  • Initial Consultation Fee: A non-refundable consultation fee of $250 is required to schedule an initial meeting with our design team. This fee covers the cost of the preliminary assessment and discussion of your project.
  • Design Fee: A design fee, which will be outlined in the project agreement, covers the creation of the design concept, space planning, material selections, and other design-related services. This fee is typically a percentage of the overall project budget or a fixed fee, depending on the scope of the project.
  • Procurement Fee: A procurement fee, typically 15% of the cost of goods purchased on your behalf, covers the sourcing, ordering, and management of furniture, fixtures, and equipment (FF&E).
  • Installation Fee: An installation fee covers the cost of installing furniture, fixtures, and accessories. This fee will be determined based on the complexity and scope of the installation.
  • Payment Schedule: Payments are typically due in installments, as outlined in the project agreement. A deposit is required to initiate the project, with subsequent payments due at various milestones, such as design approval, FF&E ordering, and installation completion.

We accept payments via credit card (Visa, Mastercard, American Express), check, and bank transfer. Late payments may be subject to a late fee of 1.5% per month. Lumiere Interiors reserves the right to suspend services if payments are not received according to the agreed-upon schedule. Any disputes regarding invoices must be submitted in writing within 14 days of the invoice date.

5. Cancellation Policy

If you wish to cancel your project with Lumiere Interiors, the following policy applies:

  • Cancellation Prior to Design Approval: If you cancel the project before approving the design concept, you will be responsible for paying for all hours worked up to the point of cancellation, at our standard hourly rate of $150 per hour.
  • Cancellation After Design Approval: If you cancel the project after approving the design concept, you will be responsible for paying the design fee in full, as well as any costs incurred for FF&E that has already been ordered.
  • Cancellation During Installation: If you cancel the project during the installation phase, you will be responsible for paying the design fee in full, the cost of all FF&E, and the installation fee for the work completed up to the point of cancellation.

All cancellation requests must be submitted in writing to [email protected]. Lumiere Interiors reserves the right to cancel a project if we are unable to fulfill our obligations due to unforeseen circumstances. In such cases, you will be entitled to a refund for any unearned fees.

6. Intellectual Property

All intellectual property associated with Lumiere Interiors' services, including but not limited to design concepts, drawings, renderings, and website content, is the exclusive property of Lumiere Interiors or its licensors. You are granted a limited, non-exclusive license to use these materials for your personal or business use, as applicable. You may not copy, reproduce, distribute, or create derivative works from these materials without our express written consent. Specifically, the design concepts presented to you remain the intellectual property of Lumiere Interiors until all fees are paid in full, and you are not authorized to implement the designs with another design firm prior to full payment.

7. Disclaimer of Warranties

Lumiere Interiors provides its services on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the quality, accuracy, reliability, or suitability of our services. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. While we strive to provide accurate and up-to-date information, we do not warrant that our website or services will be error-free or uninterrupted. Any reliance on our services is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, Lumiere Interiors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you for the services in question. This limitation of liability applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of such courts.
